Dpp Orders Arrest of Hon Mishi Mboko and Charged With Hate Speech!!

Hon Mishi Mboko women representative Mombasa county will be charged with incitement and hate speech, the DPP Keriako Tobiko  said.

On Wednesday, the office of the Director of Public Prosecutions ordered the prosecution of Ms Mishi Juma Mboko for remarks she made on June 1(Madaraka day).

Senior principle prosecution counsel Alexander Muteti appeared before a Mombasa court on Thursday, seeking orders that Ms Mboko appear in court and take a plea over the charges.

“The accused person is not in court but we have instruction that she be charged by the DPP for some criminal offences.

“We are applying to this court to summon her through the head of criminal investigation in Mombasa,” he said.

DISOBEYED THE LAW

According to police, Ms Mboko's words on Madaraka Day amount to incitement to violence and disobedience of the law contrary to section 96(1) of the Penal Code.

In the charge sheet, she is quoted as saying: “Kenyans are going to bring revolution for this country. Enough is enough. We are tired as Kenyans. Revolution is with the people. Sovereignty is with the people. Revolution is with the people, people, people,”

In the second count of incitement of ethnic hatred, she is claimed to have said: “There are two tribes that think they own this country and we want to tell them chuma wanacho.”

In his ruling, Mombasa Chief Magistrate Maxwell Gicheru directed DCIO Mombasa Ndumba Dangali to serve Ms Mboko with a summon to appear in court on June 23.
